Lt Hunt & Vinton & Haydn. Added to ye Comttee. about Fish ye two perticulars about leased lands Dismist &c And then pro- ceeded to that of the Fish, and after some Debate Voted, that Lt Jna Hunt, Sam11. Vinton, and Jonath Hayden Be added to the Comttee already chose, or heretofore Chose in that affair, and to assist the sd former Comttee and act with them in the affair, as ye sd former Comttee was Directed &c. they being all seperately, Voted to sª office.


Penn" & Baxter Chose Constble But see ye next page Baxter released. And then proceeded again to the choice of more Con- stables. The votes being collected, examined, it appeared that Willm. Penniman, & Benja" Baxter was chosen, but a mot" Being (there made on sd Baxter's behalf that he had lately served as Juryman on a Superior Courts, by reconsid" Thereof Voted, that he be released from the service of a Constable, for this year, and sd Penniman not being there his mind could not be known.


An Allowance To ye Comttee Granted in case &c And then past to that of an allowance to the Comttee &c. and the Question was put whether the Select men if need be should give ordre (to ye Comttee chose to take care of the Towns Interests, To draw money out of the Treasury as necessity shall call for in the said affair, if they must prosecute in the Law &c. provided the sd Comttee give a just acct of their proceedings, put to vote and passed in ye affirm- ative.

affire Twenty four Shillings & three pence allowed to John Webb on one Coles rate And then went upon that of a considera- tion to John Webb a late Constable on accompt of the sum of twenty four shillings & three Pence, assest upon one-Cole, in his List, Which sd sum the sd Webb saith he had not oppertunity before ye sd Coles remov" out of Town, To Collect, Voted, in ye affirmative that the said John Webb be allowed, To draw Twenty four Shillings and three pence out of the Town Treasury on the acct of sª Coles assessment.


Benja Ruggles, Chose Constable And then proceeded again to the choice of a Constable, and the votes being Collected and examined it appeared that Benjamin Ruggles, was chosen to the sd office (of Constable, but he not y" Being there his mind Could not be known.

Mr Beal released fm ye Service John Spear chose Constable. 1742 June 28th. gave his note for £5 - old tenor The Freeholders and other Qualified Inhabitants being assembled by adjournment from the tenth of this Instant, May, and they then proceeded to the affair of Constables, For, or on acct of which the meeting was adjourned to This day, and after the reports made by Constable Nath11. French and others and Debated on &c. they proceeded and on a motion then made, and for the reasons offered Voted, That Benja" Ruggles be released from serving as a Constable for this Town for this year, (to which office he was chosen on ye tenth of this Instant May. And then proceeding again to the choice of more Constables, and after the votes were Collected and exam- ined, it appeared that William Penniman and John Beal Sen". were chose, but neither of them being there their minds could not be known, But on a motion made by sundry persons there, that the sd. Jnº Beal had heretofore been chose to said office & that it has not as yet been (usual for men to serve twice In said office. Voted, that the said Mr. Jnº Beal be released from The service and then proceeded and they then chose John Spear Sent. he not being there his mind could not be known.


And Joseph Owen applied to ye meeting to consider of his appli- cation mentioned in ye warrants, and after some Debate, Stephen Cleverly, &c appearing to undertake in whole or in part to fullfil said Owen's obligations to ye Town vizt. respecting ye School Lands, Voted, that if the sd Stephen Cleverly (and others) Give sufficient security to ye Town therefor, that He be accepted, Pro- vided the affair be fairly & Justly managed with safty to the Town. [89] 1742 July 1st.


Warrants. The Freeholders and other Qualified Inhabitants of the Town of Braintree, being assembled on Legal warning for the Transacting such affaires of the said Town, the perticulars whereof, as they were Inserted in the Warrants for calling of this meeting were as follows.


First, To chuse Constables. Secondly To see if the Town Lett the Town Common, or any part thereof, or consider of any way or means whereby it may be made more beneficial to the Town. Thirdly, To hear the Report of any Committee. Fourthly, To see if the Town will abate Moses Belcher Constable any part of the tax Committed to him to assess.


Moderator. (The meeting being opened) They then pro- ceeded and chose Ephraim Thayer Moderator.


The Comttees. Report Read and accepted &c See ye Report entered at large at ye end of this meeting page 90 And then on a motion made to The meeting that as the Town had sundry times chose a Comttee to settle accompts with the Town Treasurer, and inasmuch as the Reporte of the Comttee Last Chose in that affair was offered at the Last Town Meeting (but being put off at that time because of an objection that it was not mentioned in the warrants for call- ing of that meeting) that therefore it might Be the First that might come into consideration at this, Least it might so happen, that

the other perticulars should take up the time, so as to occas" its being put off yet further - the meeting then proceeded to consider of the Reporte of the Comttee chose to settle accompts with the Town Treasurer.


The Treasurer Faxon so farr Discharged &c. The Report of Jnº. Quincy & Jos. Crossbey Esq"s. & Dea. Peter Adams being the Comttee Last chose to settle acct8. with Richard Faxon Treas- urer of this Town being Read at Large in sd meeting (now con- vened &c) the Moderator then put the Question whether the Reporte (Dated May seventh, seventeen hundred Forty and Two, and, signed by the said Jnº. Quincy &c. as above sd, be accepted, and the sd Richard Faxon Treasurer so farr fully Discharged in his trust in that affair, Put to vote and past in the affirmative. See the same, viz. the Comttees Report on page 90th.


[90] 1742 July 1st


Sam" Pen" chose Constable but also released Alexandr Marsh chose Constable after pd £5 old tenor And the Meeting then pro- ceed to that of Chusing Constables, and after the Votes were Col- lected and examined It appeared that Sam" Penniman was chosen &c. But on motion made by sd Pen" & for the reasons offered, was then released for the present year, and then proceeded and Chose Alexander Marsh, to the office of Constable, he not being there his mind could not be known.


That of ye Comon Dismist at pret. And then proceeded to that of the Town's Comon, and after some Debate Dismist it, vizt. at present.


Belcher's request allowed &c &c And proceeded to that of Moses Belchers request, and after the same was Debated, A vote was put whether Moses Belcher Secdus a late Constable should be allowed Twenty five Shillings old tenor (on the acct. of Edmond Willson and Robert Lamont) vizt. sª Belcher to be allowed the above sd sum out of the Town Treasury on their sum or sums assessed to him.


The meeting adjourned And then the Moderator with the con- sent of the meeting adjourned the meet - to Monday the Nineteenth Day of this Instant July at five of the clock in the afternoon, at the Meeting house in the Middle precinct.


The Comttees Reporte & sª Faxon so far fully, Discharged We the Subscribers a Committee appointed to settle accts with Richard Faxon Treasurer of the Town of Braintree having care- fully examined the said accompts, find that since the sixteenth of May Anno Dom. Seventeen Hundred and Thirty seven the time When he took upon him the office of Treasurer; he Has charged himself (Inclusive of the Balance of the Former Treas- urers accts.) with the sum of Two Thousd. sixty six pounds, Seven- teen Shillings & one Peney ; and has Discharged himself of the sum of One Thousand Eight Hundred and ten pounds, three Shil- lings & four Pence ; by the payment of Ord"s. Drawn upon him by ye Selectmen which sd Sum of £1810 = 03 = 04 being De- ducted from the sum of £2066 = 17 = 01 there Remains due to

Benja" Owen & Edwd Faxon chose -July 24, Ewd. Faxon gave in his note for 5f old tenor Benja" Owen Released The Freeholders and others Inhabitants of the Town of Braintree, Qualified for vot- ing in Town affairs, Being assembled by adjournment from the first of this Instant. July (after the opening of the meeting) Proceeded to the choice of Constables (ye others chosen Before &c Refusing to serve in the sd office) and after the votes were Collected and exam- ined it appeared that Benja" Owen and Edward Faxon, were chosen to sd office. But on a motion made in sd Meeting in behalf of sd Owen and for the reasons offered, Voted that the sd Benja" Owen Be re- leased from said sarvice for the present year, and said Faxon not being there his mind could not be known. and then proceeded to the choice of one more and after the votes were Collected & exam- ined it appeared that Gregory Baxter was chosen he also not being there his mind could not be known, and then the meeting was dis- mist.

Modr. vizt. whether they will insist on it The Freeholders and other Inhabitants of the Town of Braintree, Qualified for voting in Town Affairs being assembled on Legal Warning & after the open- ing said meeting proceeded and chose Co11. John Quincy Esq". Modr. the Perticulars in the Warrants Being as follows. First To consider of Choosing such number of Constables as shall Be neces- sary. Secondly, To Receve the List or, Lists prepared by the Se- lectmen to be put in a box or boxes Pursuant to a Late Law of this Province for the Regular Appointment of Jurymen &c. Third- ly, To consider of chusing a Committee to make accompts with the Town Treasurer. Fourthly, To consider whether the fine for Re- fusing to serve Constable, shall be lawfull money.


The Lists Read &c And then Proceeded, and then the Lists prepared by the Selectmen being Read the Moderator put the vote whether the Lists Now Read respecting Jurymen be accepted, and It passed in the affirmative.


[92] 1742 July 26th


A. Comttee chose And then Voted, that a Conttee be now Chosen Pursuant to the Selecting a Quarter Part of the Number Named, in the lists now Read to be Put into a Seperate Box, vizt. Tickets according to the Direction in the Law, vizt page 759,) and then Voted that Major Jos. Crossbey Esqr. together, with the Select- men now here Present vizt. Messrs Richard Thayer, Moses Belcher, and Dea. Thoms Wales, be a Conittee in the sd affair

Gregory Baxter allowed Ten pounds &c provided And then proceeded to that of Constables, and Gregory Baxter who was chose at the Last Town Meeting being Now present and Made a Motion to the Meeting, for an allowance of ten pounds in case he should serve in ye office of Constbl. and after Some Debate thereon, Voted that as the Town had at the Meeting in May last &c. Voted, that Each Constable be allowed five pounds old Tenor : vizt That sd. Gregory Baxter be allowed five Pounds More old Tenor, That is to say ten Pounds in all of the sd old tenor, Pro- vided he takes the oath of a Constable and performs in making up accts as it is Conditioned in the vote made about the allowance of the five pounds on last March as aforesaid &c.


Constables Obligations to be returned And then Proceeded to that of the Constables fines, and after some Debate Voted, that those persons that have been chosen to the office of Constables, and Have not taken the oath, be excused for this year and have their obligations Returned.


A Comttee to make up accts with ye Town Treasurer, To Report at March - And then Voted, that a Comttee Be Chose to make up accts with the Town Treasurer, and then Nomtd and Seperately Voted ye honble Jnº Quincy Esq". Jos. Crossbey Esqr. & Mr. Eben' Thayer a Comttee in that affair, they to make Report at the next March Meeting.


Jos. French Chose Constbl. Octobr. 5th. pd. £5 - Old Tenor. John Haywd Chose Constble And then proceeded to Chuse an other Constbl and after the votes were Collected and examined, it ap- peared that Josiah French was chose, he being there Refused to serve, and then on a Motion made By, Jnº. Haywd & Debated upon - Voted, That John Hayward be one of the Constbls for the Town of Braintree, and also be allowed out of the Treasury ten pounds old Tenor, one the same conditions as Baxter's aforesd was or is and at sd Haywards request Voted yt Seth Copelª. be acceptd in his Room provided he take the oath &c.


[93] 1742 Aug. 11th.


Moderator Chose The Freeholders and other Inhabitants of the Town of Braintree Qualified for voting in Town affairs being as- sembled on Legal warning For the Transacting such affairs of the Town, the Perticulars whereof as they were Inserted in the War- rants were as, Follows. First, To Give in their Valuations of their Rateable Estat's vizt (Real) Personal & Poles. Secondly, To Chuse a Constable or Constables as necessity, or as may be necessary. Thirdly, To consider what is proper farther to be done relating to the allowance to them for this present year. Fourthly, To consider whether the Town will allow any sum to any person that will take a child of Jnº Groves. Fifthly, To consider farther of Directing the Town Treasurer, about the obligations, allready taken, or that may yet be taken Into the Treasury on the account of any persons refusing to take ye Constables oath when chosen to sd office by sª Town as the Law Directs, Or any thing Else relat-

Voted Baxter & Hayward. ten pounds each old tenor &c vizt not to be a presedent Voted, That whereas at a meeting of the Qualified Inhabitants July 26th. 1742 (It being then agreed and Voted at said meeeting That Gregory Baxter and John Hayward who were then chose Constables should have ten pounds Old tenor Each, as a premium In consideration of their serving in manner as agreed at May Meet-ing Last, Which proceeding being appre- hended by the Town To be of ill consequence and (Not Legal, but in as much as said Baxter and Hayward took their oaths in conse- quence of said Premium, and therefore must serve in said office, therefor Voted, that said Baxter and Hayward have allowed them The sum of ten pounds Each Old tenor on the conditions it was Voted them wch is not for the future to be pleaded for as presedent.


Groves Child To be Disposed &c. Voted, That the affair of Jnº Groves Child be left to the Selectmen to dispose of sd Child in some good famaly for some small sum (or otherwise as they shall think best.

The Anniversary Town Meeting For the Choice of Town officers for the year, Seventeen hundred, Forty and three &c.


1742, March 7th.


The Freeholders and other Inhabitants of the Town of Brain- tree, Qualified for voting in Town affairs being assembled on Legal warning, for ye choice of Town officers, and such other affairs of sd Town ye perticulars whereof as they were Inserted in ye warrants, were as Follows. - after a Moderat' chosen. First, To chuse all such Town Officers as the Laws of this Province Directs to be chosen on ye annual Meeting in March &c Secondly, To Choose a County Treasurer. Thirdly, To if any number of persons shall have any Incouriagment to keep bulls and boars for the use of the Town for ye prisent year. Fourthly, To hear and consider of ye Request of Doctr. Henry Turner Relating to what he has done for Shove Mills Deceased. Fifthly, To Consider of an allowing of part of ye Money that ye School Lands Rent for, to the Inhabi- tants of the South Precinct towards their Providing a School amongst them as has been done For some time past. Sixthly, To consider of Laying out or allowing of town way From the Wey

Seventhly, To consider if ye Town will by themselves, or by a Comttee that by 'em shall be appointed : take into their considera- tion any affair of Christopher Dyers, (a Late Constable said Town, now under Difficulty, Respecting any assessment Committed to him to Collect, Or doe any thing to enable him to pay ye Same or doe any thing relating to said Dyers, Estate Now under Mortgage in Ord' to Secure ye Towns Money in His hands : or consider of Constable Frenches Request on said Dyers Rates to him &c. Eighthly, To hear ye Report or Reports of any of Town's Commit- tees that [95] may then be offered, and to act as shall be thought proper.

Selectmen. And then proceeded to that of Selectmen and Voted, that there be but three Selectmen to Serve the Town for this year &c and after ye votes were Collected & examined it ap- peared that Lieut John Adams, Dea : William Hunt & Ebenezer Copeland, were chosen.


The Town's Committees Report Read and accepted and ye sd Treasurer so far fully Discharged And then proceeded to that of hering the Report of The Committee that were appointed at yo Town Meeting on ye 26th. of July Last past, two of said Committee being there the sd Report being then Read which was as follows.


Comttees Report We the Subscribers a Comttee appointed by the Town of Braintree at their Meeting on ye twenty sixth of July Last, to make up accts with the Town Treasurer, Having at- tended that service and carefully examined ye sd acct Find it Right Cast and well vouched by orders upon him from the Select- men for the payment of the several articles therein Charged, And that since the Treasurer was Discharged in July last, We find that (inclusive of the Former Ballance of Two hundred and fifty six pounds, Thirteen Shillings and nine pence Due to the Town) he has charged himself with the sum of Two hundred and eighty nine pounds eight Shillings & four pence Old Tenor, and has Dis- charged himself by his [96] several payments made by Orders of the sum of One Hundred Fifty and Four Pounds, Eighteen Shil- lings and six pence, which being Deducted from ye said sum of Two hundred Eighty nine Pounds, Eight Shillings and four pence, There remains the sum of one Hundred & Thirty four pounds nine Shillings and ten pence, Old Tenor, being .Ballance Due to the Town, for which the Committee are of opinion The Treasurer is to be further accountable, and that, he be Discharged accordingly.

School money allowed to ye South precinct for ye year past & ye ensuing year And then proceeded to that of the South prets request &c. Voted, That ye South Precinct be allowed as usually heretofore apart of the School money towards providing a School amongst them, Provided it be laid out for that service &c.


Seven pounds old tenor in two Votes to be allowed to each Constable Voted, That five pounds Old Tenor be allowed to each of ye constbls That shall serve the Town in said Office ye year ensuing, vizt undr ye Same Regulations as heretofore, Provided in sd affair, and some of said Meeting after some further Debate Thereon Made a motion that a Vote of forty shillings Old Tenor Premium might be Tryed for the further Incouriaging those that shall serve in sd office the year ensuing. The Moderat". then Put ye Question whether Forty shillings Old Tenor shall be allowed and added to the five pounds above sd. for ye further Incouriag- ment of those that shall Serve the Town in ye office of Constable for ye year ensuing (viz seven pounds old tenor to be allowed to each of ye Constables that shall serve the Town for ye ensuing year, at making up & Discharging themselves of all such assess- ments as shall be committed to them to Collect) put to Vote, and it passed in the affirmative.


A Comttee chose To examine ye affair Relating to Christopher Dyer a Late Constable &c And then proceeded to that refering to Christopher Dyer, and after some Debate Voted, that a Comttee Be Chose to examine into the affaires and to reporte Thereon, at May meeting, or as soon as may be, and then Nominated and seperately Voted, Lieut. Richard Thayer, Mr. Thomas Vinton & Capt. Ebenezer Thayer be a Committee in the said affair, they Being all nominated & Sepratly Voted thereto, &c
