Constable Then Joseph Brackett was chose a Constable for the North Parish and Mattathias Cheesman for the South, who was Sworne into the office.


An Allowance to the Constables for the last year. Voted To allow to the three Constables that served the last year fourty shillings to each for their extraordinary Truble in Collecting so large a Tax.

The Committee appointed the 12th. of March 1777, To settle accot with the Heirs of Elisha Niles Esqr. decd. the Former Treasurer & with Colº Ebenezer Thayer jun" the present Treasurer, Offered their Report to the Town which was Voted accepted & stands, Recorded in the Treasurers Book Voll. 2ª. folio 273 -

Warrants. The Freeholders and other Inhabitants of the Town of Braintree Qualify'd to Vote in Town affairs being assembled, at the, Meeting House in the Middle Precient in said Town pursuant to Legall Warrant the particulars are as follows after a Moderator chosen


First, To Consider & Determine whether the Town will give their Committee who are appointed to hire men for this Town any Directions of what sums of money shall be given the men who shall engage pursuant to the Orders of the General Court of the thirteenth Instt or otherwise Determine whether the Town will adhere to their vote in December last, Respecting hireing men for Guards &c. for the future & provided they should to make some provision for ye money to pay to them.


Secondly, To act on any other Matter or thing the Town may think proper when assembled.


Moderator. Assembled as aforesaid, Capt. Peter B. Adams Moderator.


Voted, the Commanding officer of the Company be considered as one of the Committee for hireing men.


Come for hireing men. Voted, To add three in each Precient to the Committee appointed by this Town the 10th. instt to hire men &c


Then the following Gentlemen was chose, Viz. Colº. Edmd. Bil- lings Capt. John Hall, Capt. Moses Brackett, Colº. Eben" Thayer Jun'. Mess. Ichabod Holbrook, William Penniman Jun'. Majr. Turner Mes Joseph White Jun". & Matthias Cheesman.


Selectmen to provide money for sd comt. Voted, That the Se- lectmen furnish the Committee with what money may be wanted for the aforesaid purpose.


Voted, to pay the men that marched with Capt. Penniman last fall as a Reinforcement for the Northern Army from the time they marched to the last Day of November, provided they were in the service to that time.


Families of those in Conti1. Army to be supplyd. Voted, to sup- ply the families of those in the Continental Army agreeable to a. Resolve of the General Court

First, To Consider and Determine whether the Town will approve of the Constitution and form of Government proposed & agreed upon by the Convention of this State.


Secondly, To Determine what method shall be taken to procure, the shirts, Stockings and shoes for the Soldiers in the Continental army from this Town agreeable to an Order of Court.


Thirdly To Consider & Determine whether it is not for the In- terest of this Town to raise a sum of money Towards defraying the charges of said Town, or of any other purpose that may be thought proper ; and to act on any other matter or thing the Town may think proper when assembled.


Assembled as aforesaid Samuel Niles Esqr. Moderator.


The Constitution and Form of Government as was proposed by the Convention of this State being Read Voted, to Chuse a Com- mittee to take the same under Consideration & Report upon the adjournment then the following Gentlemen was Chosen Viz. Capt. Peter B. Adams, Colº Billings, Lieut Clark, Cap. Arnold, Capt Hall, Dec". Penniman, Mr. Wm. Penniman, Cap French, Capt. Wales, Mr. Hobart Clark Doct. Baker, Capt Penniman Lieut. Niles Dec". Wild & Capt. Sawen for said Committee.


Voted, That the Selectmen provide the Stockings, Shoes, & Shirts for the Soldiers as soon as possible.


Voted, That the Selectmen prepair a list of Debts that is Due from the Town & lay the same before sd Town upon the adjourn- ment


Voted, That there be one or more Inoculating Hospital or Hos- pitals for the small Pox sott up in this Town in such places as the Selectmen shall approve off & be under the Regulation & Direc- tion of the Selectmen


Voted, sd Hospitals be not continued more than three weeks from the Time they begin to Inoculate & that no Person be al- lowed to come from any other Town to be Inoculated.


Then the meeting was adjourned to the Day the annual meeting in May may be on.

Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualifyd. to vote in Town Affairs being assembled at the Meeting House in the Middle Precenct in sd Town pursuant to Legall Warrants the particulars are as follows. After a Modera- tor chosen.


First, To see if the Town will Reconsider their vote past at the last meeting for allowing one or more Inoculating Hospitals for the Small pox in said Town.


Secondly, To see if the Town will act on any artical that was Inserted in the last warrants which is adjourned to the annual meeting in May next.

Representative. The Freeholders and other Inhabitants of the Town of Braintree being assembled at the Meeting House in the Middle Precenct in said Town for the choice of a Representative pursuant to a precept directed to the Selectmen signed by the Sheriff of the County of Suffolk, made choice of Samuel Niles Esq to Represent the Town in the Great & General Court or assembly the ensuing year.


May 18th.


Report of the Committee. The Freeholders and other Inhabi- tants of the Town of Braintree being assembled by adjournment from the tenth day of March last. The Committee that was chosen the twenty second Day of December last to consider of those per- sons that have been sufferers by Reason of the War, in the year 1776 & 1777, Offerd their Report to the Town which was not accepted.


Abrm. Thayer excused from serv Constable Voted That Mr. Abraham Thayer be excused from serving as Constable this year & during his life.


Isaac Thayer to serve as Constable. Voted, that Capt Isaac Thayer serve as Constable for the Town of Braintree the ensuing year in his own turn & Receive the same allowance that was Voted, to his father or either of the Constables that was chose in March last for Collecting Tax &c.


May 18th.


The meeting that was adjourned from the 13th. of April to this day being opened, the Committee that was chose to consider of the Constitution & Form of Government Reported that they did not approve of the same it being putt to the members present 13 was in favour of the Form 74 against it.


Meeting adjourned thursday next 2 o'clock.

The Freeholders & other Inhabitants of the Town of Braintree being assembled by adjournment from the eighteenth instant which was adjourned from the 13th. April last.


£4000 Voted to pay the Debts due from the Town Voted That there be the sum of Four Thousand pounds assessed immediately on the Polls and Estates within this Town Towards paying of the Debts Contracted by said Town occasioned by the war.


3 Inoculating Hospitals Committee to appoint places, for the Hospitals Voted, That there be three Inoculating Hospitals for the small Pox in this Town for one fortnight from this Day & no longer and that there be a Committee chose to appoint such Houses as they shall think will best accommodate the Inhabitants & lay the

Then the meeting was Disolved.


June 22d.


Warrants. The Freeholders & other Inhabitants of the Town of Braintree being assembled at the Meeting House in the Middle Precient in said Town pursuant to Legall Warrants the particulars are as Follows (viz) To elect and Depute one person if they see fit to serve for and Represent them in the Great & General Court or assembly which was convened at Boston on the 27th. day of May for the service of this State and is Still in being, said person is forthwith to attend the service of this state in said General Court or assembly, & During the session or sessions of the same.


Also after a moderator Chosen.


first To See if the Town will make any alteration in their votes past in march last Respecting the Repairs of Highways the ensuing year and to act on any other matter or thing the Town may think proper when assembled.


· Representative Moderator. Assembled as aforesaid made Choice of Richard Cranch Esqr. for their Representative. Then made choice of Capt. Daniel Arnold for a moderator.


Labor on the Highways a 12/ - Voted, To allow twelve shillings, + Day for Labour on the Highways the ensuing year, that a single Poll be taxed one Days work & the Estates in the same proportion.

Subalterns wages, equal to a private Voted, To make up the Subalterns wages Equal to a Private Soldiers


Soldiers pay from the time they march to the time they git home. Voted, to pay each Soldier from the Time they march to the Time they gitt home, allowing them a days pay for every Twenty miles Travel they shall be from home when they leave the Service or are discharged.


Committee to consider, of those persons, that was in the Conti- nental army 1776. Voted, to Consider those persons that was from this Town in the Continental Service in the year, 1776, who marched out of this state & that there be a Committee chosen to take the matter into consideration & Report to the Town at their next annual meeting of what sum those persons are worthy off for their sufferings then Colº Thayer Maj. Penniman Capt. French, Capt. Arnold & Capt. Sawen was chose a Committee for that pur- pose.


Allowance to those that was in the Continental army 1776, who engaged for 3 years. Voted, to allow those persons that was in the Continental Army from this Town in the year 1776 who are now in sd army that engaged for before the twenty second Day of May 1777 Ten pounds, being the same sum that was Voted to those that engaged after sª 22 day of May. The Meeting dissolved.

Warrants The Freeholders and other Inhabitants of the Town of Braintree, being assembled at the Meeting House in the Middle Precient in sd Town, pursuant to Legall Warrants the particulars are as Follows, (viz) after a moderator Chosen.


First, To see if the Town will chuse a Committee to procure graine for the use of the Inhabitants of said Town.


Secondly, To act on any other matter or thing the Town may think proper when assembled.


Moderator. Assembled as aforesaid Thomas Penniman Esq Moderator.


Selectmen to procure corn. Voted, the Selectmen be a Commit- tee to Procure Graine for the Town and also that they procure one Thousand Bushels, if they think it will be for the Interest of the Inhabitants


Selectmen to Report to the Town whether dead money shall be Received of the Collector.


Whereas several of the Collectors have Received for Town Taxes of the Two emissions of money dated May 20, 1777 & April 11, 1778, Voted the Selectmen hear the sd Collectors and Report to the Town at their next annual meeting whether the Town shall Receive it or not.

The Anniversary Town Meeting for the Choice of Town Officers &c.


The Freeholders and other Inhabitants of the Town of Braintree Qualify'd by Law to vote in Town Affairs being assembled at the Meeting House in the Middle Parish in said Town pursuant to Legall Warrants the particulars are as follows, after a moderator Chosen.


First, To choose all such Town Officers for the ensuing year as the Law directs, also a Committee of Safety, & vote for County Treasurer, and also to raise money to Defrey the charges of the Town.


Secondly, To Determine Respecting the Repairing the Highways within said Town the Ensuing year.


Thirdly, To Determine whether the Town will Receive the Prin- cipal sums that is now due on a number of Bonds Remaining in the Treasurers hands, Or otherwise lett it lay for the Benefit of a School.


Fourthily, To hear the Petition of Josiah Quincy Esqr. & act thereon.


Fifthly, To Determine whether the Town will Build or hire a House for the Poor of the Town.


Sixthly, To Determine whether the Town will Remit to Capt Thomas Newcomb & others who are engaged in the 3 years service their Poll Tax.

Constables. Voted, to have two Constables in the middle Par- ish & also two in South Parish this year.


Chose Capt". Jonathan Thayer excused ps 331. William Bow- ditch he pª his fine on adjmt. Chose Nehemiah French, his son served ps 332 Matthew Pratt, he was excused on adjmt.


Selectmen. Voted, to have three Selectmen in the Town the ensuing year one in each Parish.


Then chose. Capt". Daniel Arnold, Mr. Hobart Clark & Th8. Pen- niman Esqr.


Then, Voted, to add four Selectmen to the three which are Chosen one in Each Parish & one at Large. Then chose Capt. Peter B. Adams, Capt". Sam1. Holbrook, Mr Joseph White jun". & Ebenezer Thayer jun". Then adjournd to monday 15th inst. ten, o'clock forenoon.

Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualify'd to vote in Town Affairs being assembled at the Meeting House in the Middle Parish in said Town pursuant to legall Warrants the particulars are as follows, after a moderator chosen.


First, To Determine whether the Town will sell or lett half moon Island (so called) agreeable to a request of a number of the Inhab- itants of said Town.


Moderator. Assembled as aforesaid and made choice Dec". James Penniman, Moderator.


Half moon Island to be leased for 3 years. Then Voted to Lease the Island for three years at Publick Vendue to the Highest Bidder.


Voted, to chuse a Committee of three to Lease the Island and also to apply to Norton Quincy Esqr. for a Quit Claim Deed of the same Committee. Then Nominated and Chose Cap Daniel Arnold Mr. Azariah Faxon & Maj Stephen Penniman for sd Committee.


Meeting dissolved.

Wm Bowditch pd fine Then William Bowditch paid five pounds as a fine to excuse him from serving.

Voted, that Swine Run at Large the ensuing year.


Hogg Reaves. Mess. Thomas Bracket, John Cleverly, John Vinton, Ebenezer Newcomb, Joshua Clark & Peter Thayer, jun". was chosen Hogg Reaves.


Committee for Fish. Voted, that Mess. Nathaniel Wales, Jona- than Thayer & Moses French, be a Committee to see that the fish are not obstructed in their passing to and from the Pond by Dams, and are not taken only on the same Days, as they were last year.


Come to see that the smelts are not Obstructed. Voted, Mes5. Samuel Arnold, Eben'. White & Ambrose Salisbury, be a Com- mittee to see that the smelts are not obstructed in the Channell between this Town & the Town of Weymouth.


Treasurer to Receive dead money. Voted, that the Treasurer be directed to Receive of the Collectors the two emmissions of money of May 20th. 1777 & April 11th. 1778 which they have Re- ceived for Town Taxes


House for ye Poor. Voted, the Selectmen be directed to Hire a House for the Poor of the Town.


Ths. Newcombs, Poll Tax Remtd. Voted, to Remitt to Capt. Thomas Newcomb, & others who was engaged in three years ser- vice their Poll Tax.


Premium for Crows heads. Voted, to give six shillings p head for all the old Crows heads, and two shillings p head for all young Crows that shall be killed in this Town the ensuing year.


Quincy Petition dismissed. Voted, to Dismiss the Petition of Josiah Quincy Esqr.


[330] Treasurer to receive the principal on Bonds. Voted, That the Treasurer be directed to Receive the Principal sum that is now due on a Number of Bonds Remaining in his Hands.


Benj Baxter to have a Deed. Voted, to Give a Quit Clame Deed to Benjamin Baxter of that House in Roxbury which was formerly his he paying the Balance that is Due to the Town and all the expenses that has or may arise to the Town on that acct and also that the Selectmen settle with him.


£4000-Raised. Voted, there be assessed on the Polls & Estates lying within this Town the sum of Four Thousand pounds towards paying off the Debts & Defreying the Charges of sª Town.


Report of that Com. that settla with the Treasurer. The Com- mittee that was appointed in March 1778 to settle with the Treas- urer Reported and the Town accepted their Report as it stands Recorded in the Treasurers Book Voll 2ª. Folº 281.


Report of the Come yt was chose to Consider of those persons in the Conti11 Army 1776. The Committee that was appointed 22d. June 1778, To consider of what sum would be proper to allow those Persons for their sufferings, who were from this Town and was Inhabitants of said Town at the Time they engaged in the Continental Army in the year 1776 Reported as follows.

To each Non Commissioned Officer and Private Soldier that marched into Canada the sum of Twenty pounds.


To each Non Commissioned Officer & Private Soldier that marched to Ticonderoga, Fort George, & New York the sum of seven pounds Ten shillings.


Your Committee are also of the Opinion that there be allow'd to each of the Commissioned Officers that Marched into Can- ada the sum of Ten pounds for their Extraordinary Services in said year.

Doc. Bakers affair. Voted That Doct". Baker be desired to leave this Town, also


Voted, that the eight men that Doct". Baker gott a warrant for go immediately and Deliver themselves up to Justice

Constables allowance. The Freeholders and other Inhabitants of the Town of Braintree being Assembled by adjournment from the Fifteenth of this Instant, Voted, to allow to the Constables in each Precient for their Collecting the Taxe's as usual the ensu- ing year the sum of Twenty Five pounds.


Hall to serve for Jonª. Baxter. Then Jonathan Baxter pre- sented Capt John Hall to serve as Constable in his place and stead. The Town Voted to accept the sª Hall to serve as Con- stable provided the sd Baxter gives Bonds for the Towns security as usual.


Jona Thayer excused. Voted, To excuse Capt". Jonathan Thayer from Serving as Constable the year ensuing


Con. Maj. Steph Penniman Made Choice of Majr. Stephen Penniman to serve as Constable he accepted.


Come for Half Moon Reported. The Committee that was chose to Lease half moon Island (so called) Reported that they had notifyd. it to be Leased agreeable to the vote of the Town; but being Informed that Mr. Quincy had leased it thought proper to Desist and lay the matter before the Town.


Voted, the same Committee see Mr. Quincy & know of him whether he has a just Right & Title to sd Island.

James Clark, Mr. Ichabod Holbrook, Colo. Ebenezer Thayer Jun'. Capt. Eliphalet Sawen, Capt". Nath1. Belcher & Mr. Azariah Faxon.


Com & allowance for last year service. Then Voted to allow the Committee that assisted in procuring men for the Public ser- vice the last year twenty shillings y Day for their Time and expenses, they laying their acct. before the Selectmen for their examination.
