He returned to S. and paid tax in 1832 and '33, after which he went to live with his dau. in Leominster, Mass., and where he d. but is bur. as is also his wife, in Vessel Rock Ceme- tery, Gilsum. 1829 he was a Sergt. in the N. H. militia. From another source he is said to have res. in Kirby, Vt., then Keene, Alstead, Gilsum, S. and Leominster. From family records we learn that William Barron Sr., after four years' service in the Rev. war came home worn out and his son William Jr., then a boy of 16 years went in his place for the rest of the war. A large stable at No. 23 at one time con- tained several high bred race horses in which he took much interest and pride,

Nothing definite can be given regarding the first American ancestor of this well known New England family, although much research has been made in this country as well as on the other side.


The progenitor no doubt was among the band of Pilgrims who came out of England and settled in America between 1625 and 1645. One of whom was Gregory Backster who m. Margaret - -, and d. at Braintree, Mass., 21- 4-1659, although there is no proof he was in anyway connected with our Surry family. From the best authority the line appears as follows :

2. WILLIAM BAXTER (Simon1) is said to have res. at Greenwich, Conn., and Westchester, N. Y. when a young man. According to the "LEGEND OF THE REVOLUTION," found elsewhere in this work, there was a "Bill Bax- ter" living at or near No. 116 about 1777; the land records throw no light on the matter and we are frank to admit we cannot to our satisfaction place a man of that name in this town during the Rev. war. There is little reason to believe the man mentioned in the "Legend" was William3 the 17 year old son of Simon the Tory. Inasmuch as Simone the Tory settled in Alstead about 1771, a possible solution of the problem is that his brother William2 came from Conn., to S. about 1776/7 and after a year or two moved to Vermont or N. Y. state. He m. and had a son. Ch. b. (was living, 1790, at Norwich, Vt.) :

3. SIMON' BAXTER (Simon1) res. Hartland and Enfield, Conn. He was in the latter town Feb. 27, 1770, when he purchased of Isaac Kibbey one half of L. 5; R. 1 in Alstead. Feb. 13, 1771, he was of Burkhampstead, Conn., and his s. Simon, Jr., of Suffield, Conn., purchased two more tracts of land in Al- stead "together with a grist mill and saw mill standing thereon" for £400. Tradition says this mill stood near the outlet of Warren pond, supposed to have been built by Capt. Timothy Delano in 1769. In a land deed of July 11, 1771 he was "of Alstead." He, John Thomson, q. v. and two others in Al- stead refused to sign the Association Test 1776, and subsequently he became one of the most notorious Tories in these parts. He was confined in the jail


in Keene and at the June session, 1777 pleaded "not guilty" to the charges. Subsequently he was lodged in the jail at Charlestown, and on the evening of June 11, 1777 "he slipped the guard" and soon after joined Burgoyne's army. Tradition speaks of him as wealthy for the times, bold, reckless, fond of en- joyment and of defying public opinion. His property in Alstead was confis- cated, and on Sept. 3, 1782, Asbalom Kingsbury of Alstead was appointed by Judge of Probate to sell the same. Tuesday, Dec. 25, 1781, "Voted to grant the prayer of the petition of Simon Baxter, and give him leave to move his family to St. John's Nova Scotia." * He d. at Norton, N. B. Mar. 20, 1804. He m. Hebron, Apr. 20 (or 30), 1749, Prudence Fox who is bur. at "The Rock"

5. SIMON3 BAXTER (Simon2, Simon1) served in Rev. war, q. v .; a farmer; had an interest in mills in both Alstead and S. In Feb. 1771 he was "of Suf- field, Conn."; in May 1772, he was "of Alstead"; in Aug. 1784 Simon3, Jr. was "of Alstead" and May 19, 1785 he was, "of Surry."-R. of D.


He was a lieutenant in the militia in 1787, and later was appointed captain. He lived at No. 116 where he kept tavern some years; a prosperous farmer and owned considerable real estate. In 1786 he purchased an interest in the "Chapin mills" at No. 112 and in 1789 bought the balance of that property, which for many years was known as "The Baxter mills." He made a will shortly before his death; inventory amounted to $10,487.00, a very comfort-

According to the "Confession of William Baxter"* there is reason to believe that the influence of his father and brother Benjamin during the early part of the war were such as to cause his sympathy with the King. He states: "I left my home 28th of March 1778 & went to Cam- bridge there I found my father and he was to be exchanged and said I must go with him I told him I Did not Love to Leave my mother he said I had bet- ter go with him & I finally concluded to go with him to Rhode Island which I Did when I got to Rhode Island I worked with one seaven or Eight Days my father Did not Do any Business that I know of then he and I went to N York and had the Small pox together and was in N. York about A month then he told me I must go to Long Island and to look out for myself," etc. He was arrested and taken before Nathaniel S. Prentice of Alstead Nov. 11, 1778, and made the foregoing confession, Jan. 8, 1779. As he stated, "I Did not Love to Leave my mother"; the dates noted above, and his age, ap- pears sufficient evidence that he was not the "Bill Baxter" of the legend. He m. (1) Nov. 13, 1781, Ruth Sheffield; dau. of Amos and Mary (Harrington) Sheffield; m. (2) Julia Swigo, who d. Sept. 16, 1853. He removed to New Brunswick with his father's family and became a doctor of note. Aug. 15, 1782 he received a grant of 500 acres of land in Susssex Co. N. B.

8. WILLIAM' BAXTER (Capt. Simon3, Simon2, Simon1) settled in Gilsum not far from 1795; he owned the mill at the Stone Bridge, then lived at the Wright farm; in 1806 settled on the Frank P. Crain farm and about 1816 rem. to No. 116 (at Shaws Corner) in S. where he d. He m. (1) Apr. 16, 1792, Thankful Smith; who d. S. Sept. 29, 1799; ae 27; dau. of Thomas Smith, q. v .; m. (2) July 7, 1800, Rachel Bill of Gilsum; b. July 20, 1774; d. Gilsum Oct. 22, 1861; dau. of Ebenezer and Rachel (Root) Bill. She was a "famous 'school ma'am,' having been employed with great success in Gilsum, Keene and Sulli- van, nearly every summer from 1787 to 1800." There is a tradition that she "left her husband" in May 1819. In 1820 he and Elijah Fuller were in busi- ness, as merchants, at No. 78. No ch.


9. GEORGE4 BAXTER (Capt. Simon3, Simon2, Simon1) enl. Sept. 25, 1814 for 60 days in the "war of 1812"; was a corporal in Capt. James M. Warner's Co .; Lt. Col. John Steele's Regt. He lived at No. 13 about 1835, and doubt- less in other places in town. Of him it was said:

10. HORACE4 BAXTER (Capt. Simon3, Simon2, Simon1) went to Rocking- ham, Vt., when a young man; studied law with Lawyer Webb; was admitted to the bar in Windham county, June 7, 1814; became an attorney of much re- pute; judge of probate many years; postmaster at Rockingham, 1812 to 1818; in 1846 he had as a law partner at the village of Bellows Falls, his son, John N. Baxter. He m. July 6, 1813, Elvira Webb, bapt. May 29, 1791; d. Sept. 23, 1861; dau. of Jehiel and Mary (Eastman) Webb of Rockingham. Judge Bax- ter was a prominent man in Rockingham; selectman, moderator, a mason, etc .; was living in a house on "the island" in 1847, when the Rutland railroad was built across his land.

11. HORACE HENRY5 BAXTER (Horace4, Capt. Simon3, Simon", Simon1) was in the mercantile business in Bellows Falls when the railroads were built through there; took a contract for grading "the island," and also three miles on the Rutland & Burlington road in Rockingham, subsequently he became a railroad contractor and manager in which he amassed a large fortune. He located at Rutland, Vt., 1854, and res. there and in N. Y. most of his after life. He was adjutant general of Vermont during the Civil war and became prominent in military circles; presented the "Baxter Library" to the city of Rutland; was noted as a "handsome man" as was his father. He m. (1) Eliza Wales of Bellows Falls, who d. Sept. 8, 1849; m. (2) Dec. 18, 1851, Mary E. Roberts of Manchester, Vt. Ch. b .:
