A PARTIAL RECORD OF HIGHWAYS IN SOUTH WINDSOR,
COMPILED BY CASSIU'S M. NEWBERRY AND RUTH T. SPERRY IN 1876, AND PUT ON FILE IN SOUTH WINDSOR TOWN RECORDS.
The Official Laying-out of the Public Road on East Side of the Great River.
At a Court of Election held at Hartford, May 12, 1670, this Court orders that the Selectmen in the respective plantations on the river shall lay out a highway six rods wide upon the upland on the east side the Great River, that men may pass to their lots there as occasion shall require, and they may order the fences to be set up in the place where they shall order the highway to be set out. And this Court grants the several plantations that their bounds shall extend to the eastward twenty rods farther than the three miles formerly grauted in consideration thereof. - Col. Rec., 1665-77.
This Court appoints Nathaniel Bissell of Windsor to keep the ferry at Scantic, to transport passengers over the Great Kiver, to take the same fare that is allowed at Hartford .- Col. Rec., 1689-1706.

Thomas Bissell, Sen., Thomas Bissell, Ir., William Taylor, Jonathan Bissell, Ephraim Bissell, and David Bissell, "all of Windsor, being sensible of our need of a highway to commons from the Country Road," mutually agreed to lay out a way for their use and benefit, " between the land of Ephraim Bissell and Thomas Bissell, Ir., to the commons (viz ): Jonathan Bissell is to allow out of his lott ten feet which his brother David is to have: David is to allow of his lot ten feet which Ephraim Bissell is to have, and also the ten foot which Jonathan Bissell is to allow out of his lot on the south side of said David's lot, and Ephraim Bissell is to allow out of his lot towards the way seven feet; and the said Thomas Bissell, Sen., and Thomas Bissell, Jr., do agree to allow out of their lots one-half rod on the north side their lot, and William Taylor do allow out of his lot toward the way one-half rod, provided Isaac Bissell will sit down so much on him; " and they mutually agreed and bound themselves each to maintain their respective proportions of fence " whether we improve in common or particular, by proportion "; and the said Thomas Bissell Senior and Junior and William Taylor "agree and oblige ourselves to fence according to each one's proportion of land on the south side of the aforesaid way; that this is our agreement to which we bind ourselves, our heirs, succes- sors aud assigns, forever." etc., 1:10/11. Record of the Highway from Hartford to Enfield, June 18, 1716.
Nathaniel Loomis, Israel Stoughton, Jonathan and John Ellsworth, Selectmen of Windsor, " by desire of some of the Inhabitants of the Town to complete the laying out the Country Road or highway on the east side the Great River in Windsor from Hartford north line to Enfield south bounds." . " began about Hartford north line where the road is now laid, and run a strait course northerly untill it cometh to the top of the hill on the east side Podunk River, where the way is now used, leaving on the east side of the way a erotched stump near ten foot high, near Hartford line, and then we turned westerly untill it cometh over Podunk River, upon the upland, and then run it northerly untill it come to the land we bought of Joseph Elmore and Jeremiah Diggons, Jr., for a Country Road. The above-mentioned way is six rods in breadth; then it is to run

westerly untill it comes to Jeremiah Diggons southwest corner of his lot, and it is to be four rods in breadth; and it is to run from Benjamin Cowlt's north fence to Enfield bounds, six rods in breadth; we continue the road as it is now laid untill it comes to the foot of a hill at John Osbarne's land, east of the bridge formerly used, and so it is to run northerly on the east side of a row of marked trees untill it comes to the east end of the Half-Mile Lott in the lot that was Hosford's, and so to continue on the east side of a row of marked trees until it comes to Enfield bounds. Lieut. Henry Woleute's Dad of a Town Way to the Inhabitants of Windsor, etc., 1720.
Henry Wolentt, "for and in consideration of my love and regard to the peace and welfare of the Town of Windsor," ete., deeded to Capt. Samuel Mather, Sam'l Strong, and Ensign William Thrall, a committee for the Town of Windsor, "one piece or par- cell of land lying in the township of Windsor, aforesaid, on the east side of the Great River, on the south side of my lott two rods and one-half in bredth, abuting westerly on James Wolcutt's land, running easterly through my said lott unto a neer stone eastward of Podunk River, partly up the hill; abutting also northerly upon the remainder of my said lott, southerly on Lieut. Nathanael Lomis' land, also another piece of land in the woods lying eastward of Podunk River, beginning at the place where the way crosses Mr. Simon Wolentt's lott, and is in breadth two rods and an half, butting westerly on said Henry Wolcutt's own land, and runs easterly through untill it comes to Hartford town line, and then turns northerly on said Henry Woleutt's land untill it comes to Wind- sor town commons, almtting northerly on the remainder of my said lott, and southerly on Mr. Simon Wolcutt's land," to "have and use the same as a publick highway." Lieut. Nathanael Loomis' Dred of a Way to the Town, 1728.
Hle conveys to Capt. Samuel Mather, Sen., Samuel Strong, and Ensign William Thrall, committee of the Town of Windsor, "a piece or parcell of land lying in said Windsor on the east side the Great River, on the north side of my lott neer Hez. Loo- mis's dwelling-house, containing by estimation two acres, be it more or less, in breadth one rod and one-half from the Country Road, till you get over Podunk River, and from thence eastward two rods and one-half in breadth, in length from said river twenty-six rods, bounding west on the Country Road, north on land of James Wolcott, east and south on the remainder of my said lott," " to have and to hold, use and enjoy as a publick townway to pass and repass in as they shall have occasion, forever hereafter." Darid Bissell's Deed of a Way to the Town of Windsor, 1730.
He conveys " for and in consideration of the sum of forty shillings, " paid by Sam'l Mather and Sam'l Strong of Windsor, and the rest of the inhabitants of said Windsor, to them " one certain tract of land lying in said Windsor, and is in length from the highway eastward to Windsor Town Commons, and is in breadth four foot north and south till it runs one hundred and nine rods and thirteen foot, the whole length through- out eastward till it come to Windsor Commons, and it is bounded north on my own land, east on Windsor Commons, south on land granted for a highway by myself, Jona- than Bissel, Isaac Bissel, Thomas Bissel, Jun'r, Ebenezer Bissel, and Nathaniel Bissel, by an instrument under our hands and seals and bearing equal date with these presents: west it bounds partly by my own land and partly by the highway; " "to have and to hold for the use of a highway for them and the rest of Ilis Majesties subjects, from time to time and at all times freely to pass and repass, as they shall have oeca- sion," etc. Sept. 15th, 1730. HIGHWAYS IN SOUTH WINDSOR.
An Act of the General Assembly Establishing the Upper and Lower Highways.
WHEREAS, the General Assembly at their sessions in October last past, granted liberty to the town of Windsor to change the two highways laid out by the jury on the east side of the Great River, in Windsor, viz., the Upper and Lower ways, provided it be done in the space of six months; and the town of Windsor did at their meeting held by adjourn- ment Feb'y 3rd, 1728/9, choose, appoint, and fully impower a committee to repair to and view the upper and lower highways and sundry other places proposed for highways, to consider the conveniency of the ground or places most fit for highways, and to determine and fix the place or places for said highways, and procure the same as cheap as might be; pursuant to which the committee did view, consider, and determine that the lower highway shall be on the south side of Lieut. Henry Wolcott and James Wolcott's lot, and the upper highway to be at and in the lot belonging to Sergt. David Bissell and Jonathan Bissell, according to the directions of the Assembly, both which ways the said committees have fixed and obtained for highways without cost and charge to said town. The said committee made report to the Town of Windsor of their doings, at their meeting held April 29th, 1729. At said meeting the Town of Windsor accepted of what their committee had done in that matter, and ordered that application shall be made to the General Assembly in May next for confirmation of the upper and lower ways obtained and fixed by their committee, and also that the upper and lower way laid out by the jury may be declared void. The prayer of the Town of Windsor respecting their highways on the east side of the Great River, heard and granted. And it is
RESOLVED and ordered by this Assembly, that the two highways, namely, the upper, in Bissell's lot, and the lower way on the south side of Lieut. Henry Wolcott and James Wolcott's lot, as it is now fixed by the Town of Windsor, be accepted, rati- fied and confirmed; and this Assembly do hereby establish and confirm the same to be the two ways in lieu of the two ways laid ont by the jury .- Col. David, Isaac, Thomas, and Ebenezer Bissell, etc., Decd of a Way to the Town of Windsor, 1730.
WHEREAS, wee, Jonathan Bissell, David Bissell, Isaac Bissell, Thomas Bissell, Jun'r, Ebenezer Bissell, and Nathanael Bissell, all of Windsor in the County of Hartford, by onr instrument under our hand and seals, dated December 28th, 1:19, did grant, sequester, set apart, and confirm one certain tract of land in said Windsor, forty-four feet in bredth north and sonth, and in length east and west from the highway on the west to the town commons on the east, to be & remain a highway forever, for us, our heirs and assigns, as by said instrument on record doth more fully appear, and whereas it is now found needful that the said way should be and remain a highway for all IFis Majesties subjects freely to pas and repas as they shall have occasion forever; now to the intent that it may be so;
KNOW ALL MEN BY THESE PRESENTS, that we, the said Johnathan Bissel, David Bissel, Isaac Bissel, Thomas Bissel, Jun'r, Ebenezer Bissel, and Nathanael Bissel, for and in consideration of the sum of forty shillings to us in hand already paid by Samuel Mather and Sammuel Strong, and the rest of the inhabitants of Windsor, do give, grant, enfeoff, and confirm to them, the said Samuel Mather of Windsor and Samuel Strong of Windsor, the said parcel of land set apart for a highway as aforesaid, to have and to hold the same to them and their heirs and successors forever, for the only use of a comon highway, for them and the rest of His Majesties snbjeets freely to pass and repass from time to time as there shall be occasion, without lett, suit, hindrance, or molestation from ns or any person or persons claiming from, by, or under us. Survey of a Road from the Main Road to the Connecticut River near the House of Alex'r King, Junior.
Noah Allyn, Hezekiah Bissell, and Justus Reed, Selectmen of East Windsor, on the 20th day of November, 1810, surveyed and laid the following highway or pent road: beginning at the west line of the street or highway at a near-stone south of the gate- post of the gate leading into the meadow north of the house of Alexander King, Jon'r, and from said near-stone we run W. 199 30' N. 86 rods and 5 links, to a bound-stone, tben W. 37º N. 35 rods and 12 links to the south end of the bridge on the drain, thence W. 19º 30' N. 61 rods to a bound-stone, and continued said course 76 rods to a bonnd now by us erected; and from the first monument at the street to the last described mon- ument the highway is 1} rods in breadth, and the line and course above described being the middle of said highway, said way extends 18 links and one-quarter link north and south from said middle or center line, and from thence runs W. 199 35' N. 11 rods to Connecticut River, which part of highway last described is three rods in width, which from the line being the center, extends 1 rod and + rod north and south,

KNOW ALL MEN BY THESE PESENTS, that I, Jacob Strong of Windsor, in the County of Hartford and Colony of Connecticutt, in New England, for divers good causes and considerations and also the sum of twenty-nine pounds, twelve shillings, currant money of New England, to me in hand well seeured in law to be paid by Wil- liam Stoughton, William Thrall, and Thomas Stoughton, Jun'r, all of Windsor afore- said, do therefore by these presents for myself, my heirs, executors, and administrators, give, grant, hargain, sell, convey, confirm, and deliver to the said William Stoughton, William Thrall, Thomas Stoughton, Jun'r, and the rest of the inhabitants of said Wind- sor, one certain parcell of land lying and being in said Windsor, situate on the east side Connecticut River, beginning at the Country Road on the east, & so to extend in length from the Country Road westerly to Connectient River, northerly on land belonging to me, the said Jacob Strong, southerly on land of Daniel Stoughton in part, and partly on land of James Rockwel, for them, the said William Stoughton, W'm. Thrall, Thomas Stoughton, Jun'r, and the rest of the inhabitants of said Windsor, to have and to hold said parcell of land as above deseribed, butted, and bounded, for a publick highway, and such other uses as their shall be cause; together with all and singular the profits, privileges and appurtenances to said land belonging or in anywise appertaining, to be and to remain to the only proper use and benefit of the said William Stoughton, Wil- liam Thrall, and Thomas Stoughton, Jun'r, and the rest of the said inhabitants of the
